Desertion — డిసర్షన్ (పరిత్యాగం)

Glossary
Family Law-I

For divorce under the Hindu Marriage Act, 1955, the Court said desertion means the intentional permanent forsaking and abandonment of one spouse by the other, without that other's consent and without reasonable cause. It is a total repudiation of the obligations of marriage.

Real-life example

The wife said the marriage was never consummated and that the parties lived separately after 21 June 1987. The Court held there can be no desertion without previous cohabitation, so her claim of desertion failed.
