Dayabhaga —

Glossary
Family Law-I

Dayabhaga is the school of Hindu law based on Jimutavahana's digest, prevailing only in Bengal and Assam. It rejects birthright entirely — no one acquires an interest in family property until the owner's death, at which point heirs take a fixed share by inheritance, as tenants-in-common.

Real-life example

A Hindu family in Kolkata follows Dayabhaga: while the father is alive, his son has no interest in the family property at all — the father could sell it entirely without the son's consent.

Common mix-up

Don't assume Dayabhaga has sub-schools the way Mitakshara does — its territory is compact enough that no regional splintering ever developed.
