Condonation means forgiveness of a matrimonial offence and restoration of the offending spouse to the same position as before the offence. Under section 23(1)(b) of the Hindu Marriage Act, 1955, relief on the ground of cruelty cannot be decreed if the petitioner has condoned the cruelty. Source: Dastane v. Dastane, 1975.
The husband proved the wife's cruelty. But the couple kept a normal married life, including sexual relations, until they parted on 27 February 1961, and she was then about three months pregnant. The Court held that the husband had condoned the cruelty.
As used in Dastane v. Dastane (Court's Reasoning, on condonation and its revival).
Don't assume condonation wipes out the offence for ever. The Court held that it is conditional forgiveness, so a fresh matrimonial offence can revive the condoned cruelty.
