Repugnancy —

Glossary
Environmental Law

Repugnancy is a conflict between a State law and a law made by Parliament on a Concurrent List subject. Under article 254(1), the State law is void to the extent of the conflict. Article 254(2) makes an exception when the President assents to the State law.

Real-life example

Tamil Nadu made an Act to allow Jallikattu. The Supreme Court held that the Act was repugnant to the Prevention of Cruelty to Animals Act, 1960 and void under article 254(1).
