Concurrent List —

Glossary
Environmental Law

The Concurrent List is List III of the Seventh Schedule. Under article 246(2), both Parliament and a State Legislature can make laws on its subjects. Article 254 settles a conflict between the two.

Real-life example

Forests are entry 17A of the Concurrent List. Parliament made the Forest (Conservation) Act, 1980 on this subject, and a State can also make forest laws that do not clash with it.

Where you'll come across this

As used in article 246(2) and article 254, and in entries 17, 17A and 17B of List III of the Seventh Schedule.

Common mix-up

Don't assume a State law on a Concurrent List subject always stands. Under article 254(1) a repugnant State law is void to the extent of the repugnancy, unless article 254(2) saves it with the President's assent.
