Substantive Equality —

Glossary
Constitutional Law-I

Substantive equality means equality of real position, not only equal rules on paper. In N.M. Thomas, the Court held that Article 16(1) is not a rigid, formal equality. It can allow reasonable measures that address real differences in the starting positions of different groups.

Real-life example

Kerala's Rule 13AA gave Scheduled Caste and Scheduled Tribe clerks more time to pass the same promotion test. The test itself did not change. By 5:2, the Court upheld the rule.
