Self-Incrimination (స్వీయ-నేరారోపణ)

Glossary
Constitutional Law-I

The act of providing evidence or testimony that could be used to establish one's own guilt — protection against being compelled to do so is guaranteed under Article 20(3).

Real-life example

Police threatening an accused into orally confessing guilt is barred testimonial compulsion; asking the same accused to give a handwriting sample for comparison is not.

Where you'll come across this

State of Bombay v. Kathi Kalu Oghad (1961) is the controlling authority, distinguishing protected "testimonial" statements from unprotected physical/identification evidence.

Common mix-up

Don't confuse with the right to remain silent generally — Article 20(3) specifically protects against COMPULSION to give testimonial evidence against oneself; a voluntary, uncompelled confession is not barred by this article.
