In Puttaswamy, a nine-judge Bench unanimously held that the right to privacy is a fundamental right. It is part of the right to life and personal liberty in Article 21 and of the freedoms in Part III. It is not absolute. A restriction must be backed by law, pursue a legitimate State aim and be proportionate to that aim.
Justice K.S. Puttaswamy challenged the Aadhaar scheme, which collected biometric and demographic data from residents. The Union Government argued that the Constitution gives no fundamental right to privacy. The nine-judge Bench rejected that argument.
