Necessity Principle — అవసర సూత్రం (Necessity Principle)

Glossary
Constitutional Law-I

The idea that police may use the power of arrest only where it is genuinely necessary to prevent offences or to investigate crime. In Joginder Kumar, the Court noted that the English Royal Commission suggested this limit.

Real-life example

The Royal Commission said detention after arrest should continue only on set criteria. One was the need to secure evidence. Another was the likelihood that the person would fail to appear in court.
