Due process is a phrase from the American Constitution. It lets a court ask whether the procedure in a law is itself fair. Article 21 does not use the phrase. It says "procedure established by law". In Gopalan, the majority held that any procedure validly enacted is enough. In Maneka Gandhi, the Court held that the procedure must be fair, just and reasonable.
అది "procedure established by law" అంటుంది.
In Maneka Gandhi, the Government impounded a passport and refused to give reasons. The Court held that the procedure under Article 21 must be fair, just and reasonable, and read a hearing into the Passports Act.
