Delegated legislation, as used in this case, is the Court's phrase for law made under power from a legislature. The Court said every rule of conduct cannot be raised to the position of legislation or delegated legislation. The judgment does not define the term.
The petitioner argued that the Central Government could not pass its Section 169 rule-making power to the Commission as subordinate legislation. The Court rejected this. It added that every norm of conduct cannot be raised to legislation or delegated legislation, and that Article 324(1) is the source of the Commission's power.
