The test given by Justice Holmes in Schenck v. United States, set out in this judgment. The question in every case is whether the words are used in such circumstances and are of such a nature as to create a clear and present danger of bringing about the substantive evils the legislature has a right to prevent. It is a question of proximity and degree.
The Court held that Section 66A fails both the clear and present danger test and the tendency test, since it has no element of any tendency to create public disorder.
