Citizenship —

Glossary
Constitutional Law-I

Citizenship is the legal status of being a citizen of India. Part II (Articles 5 to 11) says who were citizens when the Constitution began on 26 January 1950, and Article 11 leaves Parliament free to make laws on how citizenship is acquired and ends. Some Fundamental Rights, such as the freedoms in Article 19, belong to citizens only. Others, such as Article 21, belong to every person.

Real-life example

Louis De Raedt, a Belgian missionary living in India since 1937, claimed citizenship under Article 5(c). The Supreme Court held he had no domicile in India, so he was not a citizen. He had Article 21 as a person but not the right to reside and settle in India under Article 19(1)(e).
