In V. Tulasamma v. Sesha Reddy, Bhagwati J. said a widow's right to maintenance is not jus in rem, because it gives her no interest in the joint family property. The judgment does not define the term beyond this.
A widow's claim for maintenance does not make her an owner of any part of the joint family property. It is a right against that property, called jus ad rem.
Do not call the widow's maintenance right jus in rem. It is jus ad rem.
The Court said the widow's maintenance right gives no interest in the property.
Jus in rem is filed here as a general legal term.
