In V. Tulasamma v. Sesha Reddy, Bhagwati J. said a widow's right to maintenance is jus ad rem, a right against the joint family property. It gives no interest in the property itself. The judgment does not define the term beyond this.
Tulasamma had a right to be maintained out of the joint family property. When specific properties were allotted to her for maintenance, the allotment satisfied this right. It was not a grant for the first time.
Write that the widow's right is jus ad rem and not jus in rem. That makes it a pre-existing right.
An allotment of property in satisfaction of a jus ad rem does not create a new title.
Jus ad rem is filed here as a general legal term. Fazal Ali J. also lists the widow's right as jus ad rem and not jus in rem.
