Maxim
Interpretation
Literal meaningOf the same kind
Pronunciationay-YOOS-dem JEN-er-is

When a list of specific words is followed by general words, the general words cover only things of the same kind as the specific ones.

Example

A law covers 'cars, buses, lorries and other vehicles'. 'Other vehicles' means motor vehicles of that kind, not an aeroplane or a bicycle.

Essentials
  1. The statute names a list of two or more specific things.
  2. The specific things belong to one class.
  3. The list ends with general words.
  4. There is no sign of a wider intention.
Case laws
  • Powell v. Kempton Park Racecourse Co. (1899), House of Lords: the words 'house, office, room or other place' were held to mean indoor places, so an open-air enclosure was not covered.
Exceptions / limits

The rule does not apply if the specific words do not form a class or if the statute shows a wider intention.

Exam tip

Always give the four conditions and one example.

Memory trick

Same kind, same family.

Key takeaway

General words after a list take their meaning from that list.
