Res Ipsa Loquitur —

Glossary
Law of Torts

Res ipsa loquitur means "the thing speaks for itself." It is an evidentiary rule allowing a court to infer negligence from the mere fact that an accident happened, where the thing causing harm was under the defendant's exclusive control and the accident is of a kind that would not normally occur without carelessness.

Real-life example

A barrel of flour rolls out of a warehouse window and injures a passer-by on the street below. The plaintiff cannot say exactly what went wrong inside the warehouse, but because barrels do not normally fall out of windows without someone's carelessness, and the warehouse was under the defendant's exclusive control, the court can infer negligence without direct proof — as in Scott v London & St Katherine Docks Co. (1865).

Where you'll come across this

Covered in Unit IV, Post 2 on Negligence, among the doctrines that help a plaintiff prove negligence.

Common mix-up

Don't treat res ipsa loquitur as an irrebuttable presumption of liability or as a separate tort of its own. It is only a rule of evidence that shifts the evidential burden onto the defendant to offer an explanation consistent with the absence of negligence; the defendant can still escape liability by giving a satisfactory explanation of how the accident happened without carelessness on their part.
