Passing off is the common law tort that protects a trader's business goodwill from a misrepresentation that causes the public to confuse the defendant's goods, services, or business with the claimant's — proved through the "classic trinity" of goodwill, misrepresentation, and damage.

Common mix-up

Don't confuse passing off with trademark infringement. Trademark infringement is a statutory remedy that requires a registered trademark; passing off is a common law tort that protects unregistered goodwill and can be brought whether or not any mark is registered at all.
