Rectification of an instrument means that a court corrects a written contract or other instrument that does not express the real intention of the parties because of fraud or a mutual mistake. Section 26 of the Specific Relief Act, 1963 allows it. The court may refuse it, and it cannot harm a third person who acquired rights in good faith and for value.
Meena and Rajesh agree on a plot of 200 square yards. The sale agreement wrongly says 250 square yards because of a typing error. Either of them may sue to have the agreement corrected to 200 square yards.
As used in section 26 of the Specific Relief Act, 1963 and in the note on rectification of instruments.
Don't assume that rectification lets the court write a new bargain. The Supreme Court said in Venkatesha v. K.M. Venkatamuniyappa (2026) that it does not substitute one bargain for another.
Venkatesha v. K.M.
