Extra Commercium —

Glossary
Law of Contract-I

As used in Gherulal Parakh v. Mahadeodas Maiya, extra commercium (outside commerce) was the appellant's plea that a wager cannot be a business, so no partnership for wager can exist under section 4 of the Partnership Act. The Court refused to allow the plea to be raised for the first time in the Supreme Court and expressed no opinion on it.

Gherulal Parakh v.

Real-life example

The appellant argued that gambling is extra commercium, as a Supreme Court case had said about trade freedoms. The Court said the plea was not in the pleadings or lower courts and did not decide it.
