Under Section 115 of the Indian Evidence Act, 1872, a person who has intentionally caused or permitted another to believe a thing to be true, and to act on that belief, is not allowed to deny the truth of that thing against that person.
In Mohori Bibee v. Dharmodas Ghose, the appellants argued that the plaintiff was estopped by Section 115 from setting up his infancy. The Board did not decide whether the section applies to infants. It held that there is no estoppel where the truth is known to both parties.
As used in Mohori Bibee v. Dharmodas Ghose (Section 115 as quoted in the unnumbered judgment).
Don't assume estoppel applies whenever a person made a statement. The Board held that there is no estoppel where the truth is known to both parties.
