As described in this judgment, a vakalatnama is the signed written document by which a party appoints a Pleader to act for him in court. Order 3, rule 4 of the Code of Civil Procedure, as quoted in this judgment, says no Pleader may act for a person in any court unless appointed by such a document, which must be filed in court.
Respondent No. 1 signed his vakalatnama in favour of the Government Pleader, but the appeal was presented by the Assistant Government Pleader. The Court held the High Court rightly let the Government Pleader sign the memo and the vakalatnama to remove the irregularity.
As used in Sastri Yagnapurushadji v. Muldas Bhudardas Vaishya (Court's Reasoning, on the vakalatnama objection).
