A person from whom a fresh line of succession begins, as though inheritance started afresh from them. Courts use this phrase to say when someone is not a fresh stock of descent: a disqualified heir, such as a murderer under Section 25 of the Hindu Succession Act, 1956, is treated as non-existent rather than as a new starting point for inheritance, so no one can claim property through their disqualified status.
In Vellikannu v. R. Singaperumal, the Supreme Court held that a son who murdered his father is treated as non-existent, and not as one who forms the stock for a fresh line of descent — so his wife could not inherit through him either.
Vellikannu v.
As used in Vellikannu v. R. Singaperumal (Court's Reasoning), tracing the rule to the Privy Council in Kenchava Kom Sanyellappa Hosmani v. Girimallappa Channappa Somasagar, AIR 1924 PC 209.
Vellikannu v.
