Proviso — ప్రొవిజో (షరతు నిబంధన)
The Court said the normal rule is that a proviso excepts something out of the enactment which would otherwise be within its purview. A different rule may apply if the text, context or purpose so requires. Here the proviso to Section 6(1) saves dispositions, alienations and partitions before 20 December 2004.
ప్రొవిజో అనేది సాధారణంగా, చట్టం పరిధిలోకి వచ్చే ఒక అంశాన్ని దాని నుంచి మినహాయించేదని కోర్టు చెప్పింది. పాఠం, సందర్భం లేదా ప్రయోజనం కోరితే వేరే నియమం వర్తించవచ్చు. ఇక్కడ సెక్షన్ 6(1) ప్రొవిజో 2004 డిసెంబర్ 20కి ముందు జరిగిన ఏర్పాట్లు, బదిలీలు, విభజనలను కాపాడుతుంది.
The Court held that the proviso saving earlier partitions does not make the main provision retrospective. It only ensures that property available when the Bill was introduced is not taken away by fake transactions.
