Mandatory and Directory Provisions —

Glossary
Family Law-I

The Court asks whether a provision is mandatory or directory. Language alone is not always decisive; the Court has regard to the context, the subject matter and the object of the provision.

Real-life example

In Amardeep Singh v. Harveen Kaur, the Court asked whether the six-month wait in Section 13B(2) of the Hindu Marriage Act, 1955 is mandatory or directory. It held it directory and open to waiver in exceptional cases.

Where you'll come across this

As used in Amardeep Singh v. Harveen Kaur (paras 1, 17).

Common mix-up

Don't decide whether a provision is mandatory or directory from its wording alone. The Court said language alone is not always decisive; context, subject matter and object also count.
