Fault Theory of Divorce —

Glossary
Family Law-I

As used in this case: the view that divorce follows the guilt of one spouse, who is the guilty party and the other the innocent party. The judgment also calls it the guilt theory.

Real-life example

The Court said Section 9 rests on the fault theory, because it first finds fault with the spouse who withdrew. Section 13(1-A) rests on the breakdown theory.
