Right to Wholesome Environment —

Glossary
Environmental Law

The judicially-recognised right, read into Article 21's guarantee of the right to life, to live in a healthy, pollution-free environment.

Real-life example

Residents whose only water source has been contaminated by industrial discharge can approach a court directly under Article 32, arguing their right to a wholesome environment under Article 21 has been violated.

Where you'll come across this

Common mix-up

This right is not found in the literal text of Article 21 — the Article says only "life and personal liberty" — it exists because courts have interpreted "life" broadly to include this dimension, not because the Constitution names it directly.
