Biopiracy is the unauthorised access to and commercial exploitation (typically through patenting) of a country's biological resources or the traditional knowledge of its communities, without their consent and without any benefit flowing back to them — the harm the Biological Diversity Act, 2002 was enacted to prevent.

Real-life example

A foreign company obtains and patents a compound derived from an Indian medicinal plant, whose therapeutic use was already known through local traditional knowledge, without securing approval from the National Biodiversity Authority under Sections 3 and 6 of the Act — the classic biopiracy scenario the Act's access and IPR-approval mechanisms target.
