Constitutional Law-I

A doctrine under which a court's ruling applies only from the date of the judgment onward, leaving past transactions and earlier decisions made under the old legal position undisturbed.

ఒక కోర్టు తీర్పు తీర్పు తేదీ నుండి మాత్రమే వర్తిస్తుందని, పాత చట్టపరమైన స్థానం కింద చేసిన గత లావాదేవీలు, మునుపటి నిర్ణయాలను చెదరకుండా వదిలేస్తుందని చెప్పే సిద్ధాంతం.

Real-life example

In Golaknath v. State of Punjab, the Supreme Court held Parliament could no longer amend Fundamental Rights, but applied this only from 1967 onward, so earlier constitutional amendments already made remained valid.

గోలక్‌నాథ్ v. స్టేట్ ఆఫ్ పంజాబ్ కేసులో, ప్రాథమిక హక్కులను పార్లమెంట్ ఇక సవరించలేదని సుప్రీంకోర్టు తీర్పు చెప్పింది, కానీ దీనిని 1967 నుండి మాత్రమే వర్తింపజేసింది, తద్వారా ఇప్పటికే చేసిన మునుపటి రాజ్యాంగ సవరణలు చెల్లుబాటులో కొనసాగాయి.

Common mix-up

Prospective overruling is not the same as a law being repealed — it is a court deciding how far back in time its own new interpretation should reach.
