Chilling Effect — భయపెట్టే ప్రభావం (Chilling Effect)

Glossary
Constitutional Law-I

As used in this case, an argument that a State action, even if constitutional, puts a great burden on free speech because a person may hold back from exercising a protected right. The Court warned that, if not tempered judicially, the argument would result in a self-proclaiming instrument (para 147), and that a chilling-effect claim needs evidence (paras 150-151). The judgment does not give a formal definition.

Real-life example

The Kashmir Times editor said the communication and movement restrictions had a chilling effect on the press, because her Srinagar edition could not be published from 6 August 2019 to 11 October 2019. The Court found no evidence that others were similarly restricted, and treated the claim as unproven for lack of evidence.
