Maxim
Equity

A person who has acted unfairly, dishonestly or illegally in the matter cannot ask for an equitable remedy. The court may refuse relief even if the other side has also been at fault.

Example

A buyer asks the court to order the sale of a house to be carried out, but he got the contract by hiding facts from the seller. The court may refuse.

Statutory link

Section 20 of the Specific Relief Act, 1963 leaves specific performance to the court's discretion, and the court considers the conduct of the claimant.

Exam tip

Asked with the discretion of the court in specific performance.

Memory trick

Dirty hands, no equity.

Key takeaway
