Damnum sine injuria means "damage without legal injury." It describes a situation where a person suffers real, sometimes substantial, loss or harm, but no legal right of theirs has been violated. Because no legal right is infringed, the loss is not actionable in tort, however serious it may be.
A new supermarket opens across the street and offers steep discounts, causing an older store's sales to crash. The older store has no legal right to be free from competition — this is damnum sine injuria (see the Gloucester Grammar School Case, 1410).
This is one of the two founding maxims of tort law, covered in Unit I, Post 3, and referenced across nearly every unit whenever a court must decide whether real loss is actually compensable.
Don't confuse this with injuria sine damno, which is the exact opposite — a legal right violated without any provable loss. Remember: damnum sine injuria = damage but no legal wrong = not actionable.
